LJM Digital Pty Ltd trading as Kiki Clubhouse (“we,” “us,” “our,” or “Kiki Clubhouse”) welcomes you to our community platform for LGBTQ+ individuals to connect, socialize, and participate in hosted events, online interactions, and member-organized activities. By participating in Kiki Clubhouse events, using our online platform, or organizing member-hosted activities, you agree to abide by the following terms and conditions.
1. General Participation
- Participation in Kiki Clubhouse events, online platforms, and member-hosted activities is entirely voluntary. By participating, you agree to take full responsibility for your actions and conduct.
- These terms and conditions apply to all participants, whether attending an event hosted by Kiki Clubhouse, joining an online community activity, or participating in a member-organised event.
2. Event Participation and Liability Waiver
- Hosted Events: Kiki Clubhouse hosts events at venues owned by third parties or in public spaces. While the venue or council may hold primary responsibility for general site maintenance, we recommend that all participants exercise personal responsibility and caution at each event.
- Assumption of Risk: By attending a Kiki Clubhouse event, you acknowledge and accept that participation involves inherent risks, including but not limited to injuries, accidents, or damages. You agree to release Kiki Clubhouse, its officers, directors, employees, and affiliates from any liability related to these risks to the fullest extent permitted by law.
- Liability for Personal Property: Kiki Clubhouse is not responsible for the loss, theft, or damage of personal property during any event or activity.
3. Online Platform and Content
- User Conduct: All users of our online platform must adhere to respectful and responsible behaviour. Kiki Clubhouse reserves the right to remove content and, if necessary, restrict access for individuals whose actions violate our community standards or NSW law.
- Third-Party Platforms: The online platform may involve third-party software or service providers. Kiki Clubhouse is not responsible for service interruptions, data security issues, or breaches attributable to these providers.
- Limitation of Liability: Kiki Clubhouse, LJM Digital Pty Ltd, and affiliated parties are not liable for any harm arising from interactions, statements, or content posted by users of the platform.
4. Member-Organised Events
- Independent Nature: Events and activities organised by Kiki Clubhouse members are independent and not directly overseen or controlled by Kiki Clubhouse. Kiki Clubhouse provides a platform for members to connect but does not assume responsibility for any incidents or liabilities related to such activities.
- Disclaimer of Liability: Kiki Clubhouse disclaims any liability for injury, loss, or damage associated with member-organised events. By attending a member-hosted event, you agree that your participation is voluntary and assume all associated risks.
5. Health and Safety
- Personal Health Considerations: Participants are responsible for assessing their own fitness to participate in any Kiki Clubhouse event or activity. We encourage consulting with a healthcare professional if you have concerns about physical activities.
- COVID-19 and Other Health Risks: Participants agree to adhere to any public health guidelines in effect at the time of the event, including but not limited to COVID-19 precautions. Kiki Clubhouse disclaims liability for any health issues arising from event participation.
6. Privacy and Data Use
- Data Collection and Privacy: Personal data collected by Kiki Clubhouse is handled according to applicable privacy laws. Kiki Clubhouse may use personal data for internal purposes related to event organization and community management but will not share data with third parties without consent.
- Member Privacy: Members are prohibited from sharing private information obtained through the Kiki Clubhouse platform without the explicit consent of the individuals involved.
7. Indemnification
- By participating in Kiki Clubhouse events, using the online platform, or attending member-hosted activities, you agree to indemnify and hold Kiki Clubhouse, LJM Digital Pty Ltd, its officers, directors, employees, and affiliates harmless from any claims, damages, or costs (including legal fees) arising from your actions or breach of these terms.
8. Amendments
- Kiki Clubhouse reserves the right to modify these terms and conditions at any time. Notice of changes will be provided on our website or platform. Continued participation constitutes acceptance of the updated terms.
9. Governing Law
- These terms and conditions are governed by the laws of New South Wales, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
